Bail & Anticipatory Bail

Urgent bail and anticipatory bail applications before Sessions Courts and the High Court of Kerala.

An arrest or an FIR does not have to mean prolonged custody. Bail allows a person to be released from custody while a case is pending, subject to conditions set by the court. Anticipatory bail, sought in advance of arrest, protects a person who reasonably apprehends being arrested in connection with a non-bailable offence.

Applications are moved before the jurisdictional Sessions Court or, where required, the High Court of Kerala, and often need to be filed and argued on short notice. The strength of an application depends on how the FIR, case diary, and surrounding facts are presented, and on anticipating the grounds the prosecution is likely to raise.

FAQ

Common questions

What's the difference between bail and anticipatory bail?

Bail is sought after arrest or after an FIR is registered, to secure release from custody. Anticipatory bail is sought in advance by a person apprehending arrest, to prevent detention in the first place.

How soon can an anticipatory bail application be filed?

As soon as a person becomes aware they may be named in an FIR or apprehends arrest, an anticipatory bail application can be filed — there is no need to wait for an arrest to occur.

Can bail be cancelled after it's granted?

Yes. Bail can be cancelled if conditions are violated, such as tampering with evidence, influencing witnesses, or committing another offence. Compliance with bail conditions is essential to keep it in force.
